RTMNU assures compliance with Chancellor's communication by 10th

 

JUSTICE Bhushan Dharmadhikari and Justice P R Bora at ihc High Court have disposed of the seven writ petitions filed by around 400 BE students in the backdrop of the assurance given by the RTM Nagpur University's counsel, that the University would comply with the communication of April 25. 2014. received form the Chancellor and convey conclusion of consideration of [he RTMNU Management Council on his suggestions within 15 days -- by May 10 next.
Accepting suggestions of petitioners' counsel B G Kulkarni. [he Court expressed hope [hat the Management Council would reconsider the entire issue and not to restrict it self to the "narrow path" indicated by the Chancellor. The Court has also given liberty to the petitioners to approach the Court in any contingency or grievance remaining after reconsideration by the Management Council.
Now, as the ball is back in the RTMNU Court, its Academic and Management Councils have to evaluate both the aspects — amendment to Ordinance and Notification of September 13. 2013 - and decide the issue.
In terms of the notification of September 13.2013. the University had framed the scheme for the students of current curriculum to take admissions and complete the same as new syllabus has been implemented and old curriculum would be discontinued at the end of the year 2014-15.
Though the students were admitted, they completed the curriculum, but the University did not permit them to appear in the 5th or 7th Semesier examinations, which commenced from May 16 last.
After evaluation of the mailer by the Chancellor, as per his letter of April 25 last, lias been observed by him that after the decision by the Academic Council, of September I, 2013, the University had issued notification of September 13. 2013. without placing that for consideration before the Management Council.
According to the petitioners, the approval to the notification by the Management Council would provide statutory force to the said notification. The scheme framed under the notification needs to be taken to logical end and issue of appearance in examination cannot be left to mere speculation.
Advocates Abhijit Khare. Rohan and Mugdha Chandurkar also appeared for the petitioners. Advocates Purushottam Patil. Tajwar Khan and Aran Agarwal represented the University.
