HC comes to rescue of 41 Engg students: Directs RTMNU to permit them to appear in exam


IN RESPONSE to the application filed by 41 BE students for direction 10 the RTM Nagpur University to permit them to appear in the remaining papers of the 5th. 6th. 7th and 5th Semester Examination, which have already commenced from May 16 last. pending decision of the University Management Council. Justice Z A Haq. the vacation judge, at the High Court here, has after considering the facts on record, held that these applicant'- students are entitled for ad interim relief, by way of permission to them by the University to appear for the remaining papers in the examinations, which arc in progress since May 16. 2014. The Court has directed the University to take appropriate steps in the matter to do the needful in terms of its direction in this regard. The Court has made it clear, that this Court order is subject to further decision of the Chancellor and the authorities of the University in the matter.The Court has further directed that these students' results should not he declared without prior clearance from it.
The applicants' counsel Rohan and Mugdha Chandurkar . after taking instructions .made statement that they would not claim any equity because of this interim order. Now the case would he listed before the Court on June 19 next.
This application was filed by these students in the writ petition No. 1894/2014 . already disposed of by the Court on April 30 last.The Court has noted in its order that according to the applicants. I setement was made on behalf of the non-applicant -RTMNU that the meeting of the Academic Council was proposed to be held on May 5 and 6. 2014 and if the resolution
of the Academic Council was approved by the Management Council. the grievance of the applicants would not Survive. In view of this statement made by the University . the petitkm was disposed of. The Court had also granted liberty 10 the applicants to approach the Court again . if (heir grievance was not redressed.
The Court was informed today, that the University's Management Council has not taken any decision till date . though examinations of these 4 Semesters have begun.Still substantial portion of the papers remains and these students can well be allowed to appear.
The counsel for the University . Arun Agarwal opposed any interim relief to these students ,hut protecting the apprehensions expressed by him. the Court granted inter im relief to the students and balanced that making it subject to decision o the University Management on this nutter.
