Contempt notice to Abhijeet Power, MADC, MSEDCL
NAGPUR bench of Bombay High Court on Monday issued notice before admission on a contempt plea filed against Tanaji Satare. (IAS) Vice Chairman-MD. MADC. S V Chahandc. Chief Engineer. MADC. ManojJaiswal. Chairman. ABHUEET MADC Nagpur Energy Pvt.. Abhishek J.tisual. A. K. Shrivastava Director. ABHUEET MADC Nagpur Energy Pvt. Ltd. Ajoy Mehata. Chairman. M/s Maharashtra Slate Electricil Distribution Company Limited. Mumbai for "willful disobedience" and "deliberate breach" of me orders passed by Maharashtra Electricity Regulatory Commission on May 6 on the directions of the High Court.
The petitioner Industries namely M/s Kanav Agronomy. M/s Diet Food International Ltd, Ms Smart Data Enterprises, M/s Caliber Point Ltd. M/s Cynosphere India(Pvt)Ltd. have specifically complained lo the High Court that all the contemnors who have committed "willful breach" of MERC orders be punished u/s 10. 12 of Contempt of Court Act 1971 read with 215 of Constitution of India. Justice C V Bhadang while issuing notice before admission to respondents, who represents three companies expected to comply with the order and directed to them file reply by June 9. Though the petitioner had joined MADC Chairman and Chief Minister as first-respondent, the court did not issue any noice to him.
It is noteworthy that MERC has already directed that industries in "MIHAN-SEZ" should get the "effect B and sufficient" power supply as they were getting, from MADC and AMNEPL as per the directions issued by High Court.
It is necessarv to mention that the AMNEPL has arbitrarily stopped the power supply to the industries in -MIHAN-SEZ-on March 16 after daily order was passed by the M ERC. The industries in MIHANSEZ immediately knocked the doors of High Court and challenged the order on various grounds including the one that they were denied opportunity of hearing. The MERC conducted the hearing on April 30 and heard all the parties.
It is the contention of the industries that they are required to get the "uninterrupted power supply" from MADC being the "Developer of lhai "The consumers would be enabled with an option to gel uninterrupted power from MSFI K'l and MSEDCL should start supplying power to such consumers who liave applied to it. This must be done in such a manner that such consumer not availing the option do not suffer and can continue to get power efficiently and effectively as they have been getting." MERC has thus protected the interest of theMIHAN-Industrics and specifically stated that industries not availing the option to go to the MSEDCL must be protected and continue to get "efficient and effective" power supply as they have been getting till normalcy is restored. But it is found and observed that in spite of the various applications made by the industries M ADC. AMNEPL. MSEDCL have failed lo gnc the power supply.
