Gawande files suit against MPCC General Secy, two others


IN A big jolt to Chief of Maharashtra Slate Congress Committee (MPCC) Manikrao Thakare, Gajanan Gawande. who was suspended by the State unit, filed a suit in Civil Court against three Congress partymen including General Secretary of the State unit Ganesh Patil, for taking decision against him violating the norm of constitution of Indian National Congress Party (INCP).
Gawande, the City Chief of Congress Committee, in his suit mentioned that he has been working for up liftment of party in the city since many years.
However, the Slate High Command had suspended 8 Congress activists including Mayor of Chandrapur Municipal Corporation (CMC) Sangeeta Amrutkar. President of Standing Committee of Ritesh alias Ramu Tiwari. Civic Chief of Ballarpur Municipal Council Rajni Mulchandani and five other activists from the party on the basis of complaint filed by the Guardian Minister of the district Sanjay Deotale. who faced debacle in the recently held Lok Sabha election.
The decision of State unit of suspending 8 Congress activists, signed by General Secretary Ganesh Patil. is totally one-sided and unconstitutional under the norms of INCP. Even though the State High Command had not sent the suspension letter to party activists, it circulated the letter to the journalists who published it before the general elections.
"Instead of issuing a showcause notice 10 me. the MPCC had suspended me from the party leveling allegations of participating in the amiparty activities. There are norms under constitution of INCP that MPCC should have to issue a show-cause notice to hear my side, but it was not done by the high command. Moreover, there are norms under INCP that the All India Congress Committee (AICC) has authority to take a decision after my side has been heard by party high command. Until then the post must remain vacant," informed Gawande in his suit.
lie also accused Sanjay Deotale of working against party's interest.
In his appeal, he requested the court to declare the MPCC decision as unconstitutional, and declare null and void appointment of Nandu Nagarkar as City Chief
It may be the first incidence where a district-level activist has dragged the Chief of State unit to court for
