Nazul land holders get prepoll gift from State Government


TO REGULARISE Nazuul plots of Nagpur and Amravati division, the Maharashtra Government has amended earlier rules for regularising in change of user of plots. The notification issued recently by the State Government suited that the lessee, who had changed the user without prior permission of the competent authority, would be required to pay 25 per cent of then ready reckoner rales. The plot holders who want to change the user, now will be required to pay 12.50percent of present ready reckoner charges. The Government claimed that this would give great relief to user as then ready reckoner rates were quite less as compared to present rates.
Revenue Department of the State Government has issued notification before ensuing assembly elections to lure Nazul plot holders. It may be mentioned that the earlier order was opposed by State BJP President Devendra Fadnavis. Krishna Khopde, Sudhakar Deshmukh and others in Stale Assembly and has insisted that Slate Government must change it accordingly.
The State Cabinet took decision on July 7, 2014 and notification was issued on August 1.2014. The decision will benefit 36.791 Nazul lease holders of Nagpur and Amravati. The decision regarding regularisation of plots was pending since years.
As per decision, die ground rem of lease plots on auction would be 0.10 per cem of ready reckoner for residential, 0.15 per cent of ready reckonerfor commercial use for plot size up to 1000 sq fis. 0.20 percem of ready reckoner for plot size between 1000 to 3000 sq fts, 0.25 per cent of ready reckoner for plot size between 3000 sq ft to 5000 sq ft. and 0.30 per cent of ready reckoner for plot size above 5.000 sq fts. The plot used for religious or social cause will have to pay 0.10 per cent of ready reckoner rates.
Earlier, the lease holders were paying heavy sum for regularisation of plots. As per earlier decision, if a plot holder transferred the lease to another person or  change its use without permission of competent authority, then he/she had to pay fine to regularise it. This penalty is known as unearned income and it was 25 per cent of the market value of the properly at the lime when the plot holder submitted die application for reg-ularisation.
As per present notification, the market value for 25 per cent unearned income would be considered on me basis of the date when the irregularity was committed. The plot holders will have to pay as per ready reckoner rates at the time of irregularity. In case documents pertaining to illegal transfer of lease are not available, such documents should be first registered and the market rate for unearned income would be the one prevailing on the date of the registration.
