IN AN interesting petition filed before the High Court. a senate member of Rashtrasant Tukadoji Maharaj Nagpur University (RTMNU) has sought appointment of a full-time Vice-Chancellor (V-C) as contemplated under Section 12(5) of the Maharashtra Universities Act and has urged the court to interpret the section which gives power lo the t hancellor lo appoint an eligible person as Vice Chancellor. According to the petitioner, the Chancellor is duty bound to appoint only eligible candidate which as per rules means an academician with a doctorate, at least 15 years of teaching experience and administrative experience as Vice Chancellor. Questioning the March 30. 2014 order issued by the Chancellor appointing Divisional Commissioner Anoop Kumar as officiating V-C of RTMNU. the petitionerelaimed that after the rules were framed specifying the qualification of V-C. the Chancellor ought to have appointed an academician who is eligible and suitable to hold the post of V-C.Clarifying that he had nothing personal against any individual including Divisional Commissioner, the petitioner claimed that even the Chancellor can not go beyond the statute and regulations framed thereunder.
A division bench consisting of Justice Bhushan Gavai and Justice Sunil Shukre after a motion hearing issued notices to State Government, its higher and technical education department. Chancellor and present officiating V-C asking them to file reply within two weeks.
Anoop Kumar was appointing following resignation of Dr Vilas Sapkal as V-C of RTMNU following a major row over banning of 250 colleges and his tiff" with academic heavyweights and members of statutory bodies.
Petitioner Gurudas Kamdi's counsel Adv Bhaundas Kulkarni claimed that V-C is ex-officio head of all statutory bodies of the university and head of the selection committees and hence it is necessary that such post must be occupied by an academician to fulfil the mandate of the Maharashtra Universities Act and for better management of the university. The normal process to appoint a regular V-C is time consuming as first a search committee needs to be formed which then invites application, scrutinizes them and submit a panel 10 Chancellor who then lakes the final call.
Since the petition seeks inter pretation of the Chancellors power, therefore, instead of approaching the Chancellor under Section 108 of (lie Maharashtra Universities Act. the petitioner has approached the High Court.
Prior to framing of rules spec ifying the eligibility of candidates aspiring to become V-C, the Chancellor could nominate administrative officers like Divisional Commissioners or senior I AS officers or a senior Principal of an affiliated college. But. now. the Chancellor has no option but to appoint a full-time V-C. the petitioner claimed while making it clear that any suitable and eligible candidate be appointed as V-C at die earliest.
