Govt's pre-poll bonanza to land
BEFORE election code of conduct come into force, the Maharashtra Government has settled pending land related issues of Nagpur. The Government has sanctioned conversion of agriculture land to residential zone on whopping 16.44 hectares (41 acres) land at Nara in North Nagpur while it allowed user change from Agriculture zone to Residential zone in Mouza Ghogali on 23.74 hectares (59.35 acres land outside city limits recently.
The Government has issued notification regarding conversion of land and sanctioning of layout. It may be mentioned that develop- The Government has appointed Nagpur Improvement Trust (N1T) as nodal agency for sanctioning layouts and conversion of zones form agriculture to residential, in this situation, the notification issued by Government have raised eyebrows in really and official circles.
Urban Development Department of Maharashtra Government has sanctioned user change of 16.44 hectares land of Nara from agriculture to residential on survey number 214 and 215. The land belongs to Mohinder Singh Rawal, Vedprakash Wadhwani. and Anil Gotmare.
The Town Planning Department of Pune has sanctioned proper modification with some changes and condition.
As per condition, the land owner or developer will have to make road access having minimum width of 18 ml to the said land at their own cost. The land owner should hand over 50 per cent of total area of the land 8.22 hectares for affordable housing, out of which 3.29 hectares shall be handed over to MHADA and 4.93 hectare will be given to Nagpur Improvement Trust (NIT) free of cost.
The land owners will have to hand over parcel of land within one month from the issuance of notification. The parcel of land to be handed over the MHADA and NIT shall be free from all encumbrances. The MHADA and NIT will develop affordable housing hv utilising 2.5 FSI.
After handing over the parcels of land, the remaining land left with the land owners for development. additional PS1 equivalent to the 20 per cent of the said land shall be permissible, over and above the original FSI of remaining land. The additional FSI shall be permissible on prorata basis on all the plots on remaining land. It is duty of land owner to provide and develop the required amenity space in the layout, in addition to the required 10 per cent open space, as per prevailing Development Plan of NMC. All the basic amenities required for the land remaining with the land owners, shall be developed and made available by the developers at their own cost.
NIT shall develop such amenities if full cost of such requisite amenities, is deposited by the land owners with the NIT.
Il is responsibility of land owners, lo provide potable and sufficient water supply at their own cost. In case of non-compliance, layout approval and non-agriculture permission shall be liable for cancellation. If developer proposes Group housing scheme, then the occupation certificate shall not be given unless all basic amenities and amenity space specified by the NIT chairman are fully developed.
After final approval
of layout, the sale of 25 per cent of total plots shall be permissible. The release of plots depends on completion of amenilies on the layout.
Government allowed user change on land of Bhagwat Nare in Ghogali area. The total land is 23.74 hectares hearing Gal number 19/1. 19/8. 19/9. 19/10 and 19/11 in Nagpur Tehsil area.
The Government has modified regional plan as per provisions of sub-section (2) of section 20 of the act. to include the land in residential zone with some condition.
In the layout, in addition to 10 per cent compulsory open space, required amenity space shall be provided as per prevailing DCR for the regional plan.
The amenity space shall be developed by land owners. The land owner will be responsible to provide pure and sufficient water supply required for the development of the land at his own cost. The land will be released after completing basic amenities by the developer. Incase of non-compliance, layout approval and non-agricultural permission shall he cancelled.
