GAT ALLOWS APPLICATION FOR COMPASSIONATE APPOINTMENT


A BENCH of Central Administrative Tribunal (CAT), Jabalpur, comprising Administrative Member G P Singhal has allowed application for compassionate appointment tiled by Sandeep Kumar Rajak and given directions that impugned order dated on October 31, 2012, is quashed and set aside.
The respondents are directed to consider and decided claim of applicant on basis of assessment of indigency done earlier in which he has got 67 points and if any person who got 67 or less marks than that has been appointed in consideration done by competent authority of the department after September 4. 2012, then the applicant should also be given appointment without any further delay.
This exercise should be completed within a period of three months from the date of communication of this order. Respondents are further directed to pay a cost of Rs 5,000 to the applicant of this litigation. The application filed against the Chairman-cum-Managing Director, Bharat Sanchar Nigam Limited. New Delhi. Chief General Manager. Bharat Sanchar Nigam Limited. Bhopal,     Engineering     Officer, Telecom Projects East Madhya Pradesh Area, Jabalpur and Divisional Engineer. Telecom Projects Easi Madhya Pradesh Area, Jabalpur. This is the second round Of litigation.
The applicant had earlier filed application tor direction to respondents to grant him compassionate appointment and the said application was allowed by tribunal order dated on September 4. 2012. with a direction to respondents to reconsider application of the applicant lor grant of compassionate appointment, in the light of document and decide his claim by a speaking order.
However, the respondents again rejected claim of applicant for compassionate appointment impugned order dated on October 31. 2012, by observing that as per direction of this tribunal a welfare officer of BSNL Local Unit. Jabalpur. visited applicant's premises on September 28, 2012, to assess financial condition of deceased family member and in considering his report the applicant is found to be ineligible for grant of compassionate appointment.
