HC allows construction firm to withdraw plea against VIDC
IN THE face of total disinclination on the nan of Justice Vasanli Naik and Justice P R Bora at the High Court to entertain the writ petition filed by M/s Adiiya Construction Company, as a lot many disputed facts are involved, fit for adjudication in proceedings before Civil Court, the petitioner-partnership firm sought the permission from the Court to withdraw the petition. The Coun permitted the firm to do so and made it clear that in view of disposal of the petition, interim relief operating till date, does not subsist any more. The petition was directed against a letter received by it from the Executive Engineer. Minor Irrigation Division No. 2, Karanja (Lad) in Washim district, on April 9 last, informing it that it was granted extension to complete the work till March 31. 2014 and as the work was not completed by that date, hence under the clause 4 of the tender, the said authority was withdrawing the work from it and had asked the petitioner to remain present for joint measurement on April 22 last. As the petitioner received the said letter at 3 pm, its nominee could not attend the "measurement The bid of the petitioner - 5.79 per cent above the estimated cost - for the Rs 973.76 lakh tender, was accepted by the respondent-authorities and the work order was issued to it on January' 27, 2010 for execution in 24 months. The tender was for Construction Of Earthen Oam Waste Weir. Head Regulator. Excavation of Tail Channel and allied work. Senior counsel Anand Jaiswal with Adv N A Padhye appeared for the petitioner. Advocates Sanjay Jagtap and Jemini Kasai (VIDC). and Adv Vivek Palshikar (Chief Engineer, Rajendra Pawar and Executive Engineer. Jayant Shhlde) represented the respondents.
