HC's status quo on diverting PDKV land for extension of Akola airport
IN RESPONSE 10 the public interest litigation (PIL) filed by Vidarbha Association for Research Technology and Development in Agricultural and Rural Sector VART - DARS President Dr B G Bathkal. former Vice Chancellor of Dr Punjabrao Deshmukh Krushi Vidyapeeih (PDKV). against the impugned Government Resolution <GR) of March 4. 2014 for diverting PDKV land reserved for research projects for non-agricultural purposes including extension of Sivni airport at A kola. Justice Bhushan Gavai and Justice C V Bhadang. at the High Court here, have ordered status quo. The Court also issued notice to the respondents - Slate Chief Secretary. Additional Chief Secretary (Aviation). Principal Secretary. Agriculture.Registrar. PDKV and the Collector. Akola - to show cause after two weeks in reply to the PH.. The impugned GR is meant for transferring 60.68 hectare land owned by the PDKV along with build en as it would have adverse effeet on its important research projects. The petitioner also made a representation to the State Chief Minister opposing the idea of acquiring its land for the airport.
Aiadistanceof75kmsfromSivni. the State Government has resolved to develop Beloraairport at Amravati and for that made available Rs 34 crore on February 28, 2014 for creating infrastructure.
On March 4, 2014. wooden heatedly ignored the Central Policy in this regard and also the adverse impact it would have on the research projects and decided upon to acquire the said land by issuing the impugned resolution.
According to the petitioner, the Resolution is contrary to to the Central Government's guidelines on the aspect of distance between two airports. This Resolution is contrary to State Government's own GR of July 30. 2007.
