Akola court grants MCR to Wasankar
A SPECIAL Court at Akola rejected the request of the prosecution for further police custody of Prashani Wasankar and Abhijit Chaudhary and sent them to magisterial custody. The prosecution, while requesting for extension of police custody remand, argued that the investigating machinery required further custody of Prashani Wasankar. Abhijit Chaudhary and Vinay Wasankar to ascertain and interrogate various facts. It was pointed out that Prashani Wasankar had duped investors at Akola. The prosecution contended that they required custodial interrogation of the accused persons to ascertain what the accused had done with the amount accumulated and wanted to search the documents and house and office premises of the accused persons. The prosecution claimed that if further police custody was granted, they would be in a position to unearth the 'hidden' amount. The prosecution also imposed sections under the provisions of Maharashtra Protection of Interest of Depositors Act (MPII)A) against the accused, though initially offences were registered only under IPC. Countering the request of prosecution for police custody. Adv Prakash Naidu appearing for Prashant Wasankar and Abhijit Chaudhary argued that the entire data of alleged transactions, bank accounts, cheque books and all relevant documents and articles alleged to have been functional in the alleged offence, had already been seized by the investigating agency at Nagpur by the Economic Offences Wing (EOW) officers and that Wasankar had noting to disclose and was not in custody of any document. It was also argued that slapping of provisions of MPIDA was not warranted and not sustainable. Adv Naidu pointed out to the court that the police had sought PCR and the court had granted it for four days since the police had contended that they intended to go to Nagpur for necessary investigations.
